AgeVerif.com is a service owned and operated by PlanetSeason. At PlanetSeason, the privacy and security of the personal data of users of online services, Clients, visitors and other partners are aspects that are of crucial importance.
The commitment to the security of personal data is assumed by PlanetSeason's Management and extends to all company employees. PlanetSeason promotes information security and protection in the processing of personal data stored by the company and collected either through personal contacts, telephone or electronically, namely through communication by email, website, social networks or sharing by partners or other interested parties.

In the processing of personal data we respect your privacy, we reiterate our commitment to implementing compliance measures, in particular to ensure:

  • lawful processing, supported by a legal basis, legitimate interest or your consent;
  • that the processing is limited to the purpose for which the data was made available;
  • that mechanisms are in place to obtain accuracy and completeness of the data provided by you;
  • the minimization of the required data, requesting only those appropriate to the purpose;
  • the limitation on data storage, according to the defined retention periods;
  • the implementation of measures for the integrity and confidentiality of information.

PlanetSeason has defined procedures for the company's compliance with the principles described above and requirements of the General Data Protection Regulation (GDPR), for existing information systems and to carry out a prior impact assessment and implementation of privacy measures in new data processing to be carried out in the future.

1. PlanetSeason

PlanetSeason - Unipessoal Lda's activity is the development of websites and applications.
The registered office of PlanetSeason is Rua Nova do Amparo, nº1, Edifício Quinta Piornais, Bloco B, fração W, 9000-639, Funchal, Portugal. PlanetSeason is registered at the Commercial Registry Office of the District of Madeira under number 518 490 831 and is the data controller of personal data, as specified in the paragraph 2 of this Privacy Policy.

2. AgeVerif.com Services

The purpose of the AgeVerif.com Services is to provide reliable, anonymous and secure online age verification and validation solutions. The AgeVerif.com Services are intended for any Internet user who wishes to prove that they are of legal age to access websites and/or content that are prohibited to minors.
The AgeVerif.com Services are not intended for persons under eighteen (18) years of age. We do not knowingly collect or process personal data from children under thirteen (13) years of age. If such data is identified, it will be immediately deleted.

The AgeVerif.com Services are accessible either on the AgeVerif.com site or through an embedded module on the Clients' third-party websites. The AgeVerif.com Services offer different Age Verification Methods. The following list resumes them and explicitly informs about the Controller of each operation, indicating a link to the Privacy Policy for Independent Controllers.

AgeVerif System was designed to minimize personal data, using only the data strictly necessary for age verification, according to the method chosen by the user. Biometric data of users who choose facial recognition as an age verification method are only processed in the user side and are not stored by AgeVerif System.

2.1 Age Verification Method

  • Estimate by email
    We examine, based on the email address entered by the User, the websites and applications on which this email address has already been used to determine their age. Only the data with older age is stored (considering leak age and requirements on age to be registered in that site)

  • Facial recognition estimation (Selfie)
    The User is invited to use the camera of his Device. The captured image is analyzed on the User's Device. The entire facial recognition and age determination process is carried out on the User's Device. No images are collected or transmitted to the AgeVerif servers or to the Clients.

  • Verification by AgeVerif ticket (Only in France)
    The User must first obtain an AgeVerif ticket from partner tobacconists. The sale of the ticket is subject to the verification of the User's age of majority by the tobacconist using a valid identity document. The AgeVerif ticket contains a single-use code valid for 2 months. The AgeVerif ticket is not returned, exchanged, reimbursed and cannot be the subject of any consideration in kind, cash or transfer.
  • Credit card verification
    The User is invited to make a single transaction in the amount of one-euro (€1.00) coupled with strong two-factor authentication in accordance with the European Directive (EU) 2015/2366 on payment services (known as "PSD2"). Transactions are insured and secured by Stripe, Inc.

  • Credit card verification coupled with a VPN (Virtual Private Network) service subscription.
    The User is invited to subscribe to one of the subscription offers for a VPN service. The VPN service is accessible after payment for a period that varies according to the subscription package chosen by the User at the time of subscription. Access to the VPN service begins as soon as the purchase is validated. Transactions are insured and secured by Stripe, Inc.

  • Verification with the AnonymAGE application
    AnonymAGE is a third-party legal age verification solution that allows its users to have their age of majority verified and validated. The User is invited to scan a QR code or click on a link to launch the AnonymAGE application on their device. The AnonymAGE application, with which the User will have previously validated their age of majority, confirms or denies the User's age of majority to AgeVerif. The User's data previously transmitted to AnonymAGE to validate their age of majority are not communicated to AgeVerif.com or to the Clients' websites.

  • Verification with Pleenk
    Pleenk is a third-party service for estimating and verifying age of majority by means of facial recognition (selfie) or by verifying an identity document from which the information necessary to validate the User's age is extracted. The User's data transmitted to Pleenk to validate their age of majority are not communicated to AgeVerif.com or to the Clients' websites.

  • Verification with AgeGO
    AgeGO is a third-party service that estimates and verifies age of majority using facial recognition (selfie). For additional confirmation, Users may be asked to scan a valid ID from which the necessary information is extracted to validate the User's age. The User's data transmitted to AgeGO to validate their age of majority are not communicated to AgeVerif.com or to the Clients' websites.

3. Categories of Personal Data processed by PlanetSeason

For the execution of AgeVerif Services, PlanetSeason may process the following categories of personal data of its visitors, Clients and users of the AgeVerif.com Services:

  • identification data (if provided by the user in the contact form);
  • contact data (email address, history of breaches related to the email address);
  • demographic data (only the preferred language, automatically detected by the site and editable by the user);
  • biometric data (facial representation generated from the user's biometric data);
  • financial data (information relating to payment transactions);
  • electronic identification data (e.g., session ID, connection IP address).

4. Purposes, basis of processing and storage periods of personal data

4.1 AgeVerif users

In the pursuit of its duties, through a contractual relationship, legal obligation and/or legitimate interest, PlanetSeason may process the personal data of AgeVerif users and visitors of AgeVerif.com or AgeVerif.plus, for the purposes described below.

4.1.1 User account management

  • Purpose of processing: Store status of age verification for the time period defined in Terms of Use.
  • Personal Data categories: Email.
  • Legal basis for processing: Pre-contractual diligences, execution of a contract and post-contractual diligences arising from the relationship with the user or visitor.
  • Data retention period: For as long as the contract is ongoing or until the data subject exercises the right to rectification and erasure.

4.2 AgeVerif users Webmasters

In the pursuit of its duties, through a contractual relationship, legal obligation and/or legitimate interest, PlanetSeason may process the personal data of AgeVerif users Webmaster and visitors of AgeVerif.com, for the purposes described below.

4.2.1 Webmaster User account management

  • Purpose of processing: Manage costumer websites and AgeVerif plug-in configuration. AgeVerif use statistics.
  • Personal Data categories: Email. Passkey.
  • Legal basis for processing: Pre-contractual measures, performance of a contract, and post-contractual obligations arising from the relationship with the Webmaster use.
  • Data retention period: For as long as the contract is ongoing or until the data subject exercises the right to rectification and erasure.

4.2.2 Webmaster user contact via the contact form

  • Purpose of processing: Information requests, suggestions, complaints or commercial requests for online users.
  • Personal Data categories: Email. Data entered by the user (subject/body of the message) that may contain personal data.
  • Legal basis for processing: User unequivocal consent.
  • Data retention period: Until the data subject revokes their consent.

4.3 Visitors to the websites of AgeVerif Clients (Webmasters)

AgeVerif provides its Clients (Webmasters) with a plug-in allowing them to use AgeVerif’s Services to verify the age of their visitors to access websites and/or content prohibited to minors.
The Extension Module consists of a window that is superimposed on the Client’s website and offers the user several Age Verification Methods. When the visitor has verified his/her age with the Plug-in, he/she may access the Client’s website and/or certain types of content and any other website and/or certain types of content using AgeVerif’s Services.
In these cases, In the pursuit of its duties, through a contractual relationship, legal obligation and/or legitimate interest, PlanetSeason may process the personal data of visitors of AgeVerif Client’s websites, for the purposes described below.

4.3.1 Verify age using AgeVerif Account

  • Purpose of processing: Verify or estimate the age or age range of a user.
  • Personal Data categories: Email. Site ID and Verification token.
  • Legal basis for processing: User unequivocal consent.
  • Data retention period: Until the data subject revokes their consent. Cookie conservation period: 1 hour in cookie session.

4.3.2 Estimate user age by email

  • Purpose of processing: Verify or estimate the age or age range of a user.
  • Personal Data categories: Email. Email breaches history. Site ID and Verification token.
  • Legal basis for processing: User unequivocal consent.
  • Data retention period: Until the data subject revokes their consent. Cookie conservation period: 1 hour in cookie session.

4.3.3 Facial recognition, for age estimation (Selfie)

  • Purpose of processing: Verify or estimate the age or age range of a user.
  • Personal Data categories: Biometric data (face’s representation based on user biometric data). Site ID and Verification token.
  • Legal basis for processing: User unequivocal consent.
  • Data retention period: Cookie conservation period: 1 hour in cookie session.

4.3.4 Credit card, for age estimation

  • Purpose of processing: Verify or estimate the age or age range of a user.
  • Personal Data categories: Uses Stripe services (No credit card data is stored by AgeVerif Services). Site ID and Verification token.
  • Legal basis for processing: User unequivocal consent.
  • Data retention period: Cookie conservation period: 1 hour in cookie session.

4.3.5 AgeVerif’s Services by Site Plug-in

  • Purpose of processing: Launch AgeVerif Service.
  • Personal Data categories: User browser language (auto). Site ID and Verification token.
  • Legal basis for processing: Execution of a contract with the website Client.
  • Data retention period: Cookie conservation period: 1 hour in cookie session.

The processing of personal data of minors under 16 years of age is not foreseen. AgeVerif System, by design and by default aims to control the age of users to prevent minor to access to Client's websites. Information notice and user confirmation of being an adult is made, before processing data.

5. Sources of Personal Data

We process your Personal Data through the following sources:

  • AgeVerif.com website: Services used to maintain electronic communications between the data subject and PlanetSeason, including age verification services and contact message form.
  • AgeVerif Plug-in: The Extension Module consists of a window that is superimposed on the Client’s website and offers the website visitors AgeVerif’s age verification methods.
  • Email: The contact form requests and responses will be managed by [email protected].

6. Transfer of personal data with other entities

In order for PlanetSeason to be able to fulfil its duties and to provide you with a quality service, it may have to communicate your personal data, or give access to it, to other entities:

In these cases, PlanetSeason will only transmit your personal data to the following categories of recipients:

  • entities and authorities to whom personal data must be communicated by virtue of a legal obligation;
  • entities associated with the group of companies to which PlanetSeason belongs or subcontracted by them;
  • entities supporting online services of AgeVerif System. International data transfer may occur for the purposes of fulfilling contractual obligations. To ensure normal operation and personalization, AgeVerif website and its Services may use cookies.

  • the retention period of the collected data;
  • how consent can be withdrawn;
  • for all cookies that require consent, the user's consent to apply the cookies will be obtained in advance;
  • the method for withdrawing consent to cookies by the user will be as easy as giving consent.

8. Rights of Data Subjects

Users and Clients, as data subjects, enjoy the following rights:

8.1 Right of access

Whenever you request it, you can obtain information about which of your personal data is processed by PlanetSeason. You can also access your personal data, as well as obtain the following information:

  • the purposes for which your personal data is processed;
  • the type of personal data that is processed;
  • the entities to whom your personal data may be communicated, including entities from the European Union or international organizations;
  • the period for which your data will be stored or, if this is not possible, the criteria for setting this period;
  • the rights you enjoy in relation to the processing of your personal data;
  • if the personal data has not been collected from you, information about its origin and type of data in question.

8.2 Right to rectification

Where you consider that your personal data (provided by you) is incomplete, you can ask for it to be completed, or you can request that it be rectified if it is found to be incorrect. (e.g. email address, contacts, personal preferences).

8.3 Right to erasure

In certain circumstances, the data subject may request the erasure of their personal data. PlanetSeason will inform you of the possibility or not of satisfying this right in the face of existing retention obligations due to legal imposition or legitimate interest.

8.4 Right to restriction of processing

The right to restriction of the processing of your personal data entitles you to request the controller to restrict the scope of access to and processing of your personal data or to suspend the processing activities. You may request the restriction of the processing of your personal data in the following cases:

  • if you contest the accuracy of your personal data, for a period of time that allows PlanetSeason to verify its accuracy;
  • if PlanetSeason no longer needs the personal data for the purposes of processing, but if such data is necessary for the establishment, exercise or defense of legal claims.

8.5 Right to portability

You may request PlanetSeason to deliver, in a structured, commonly used and machine-readable format, the personal data provided by you. You also have the right to request that PlanetSeason transmit this data to another controller, as long as this is technically possible.
The right to portability only applies in the following cases:

  • where the processing is based on unambiguous consent or the performance of a contract;
  • where the processing in question is carried out by automated means.

8.6 Right to object

You have the right to object to the processing of your personal data at any time, on grounds relating to your particular situation, and when the processing is carried out for purposes other than those for which the data were collected, but which are compatible with them.
In such cases, PlanetSeason will cease to process your personal data, unless it has legitimate reasons to carry out such processing and that these reasons prevail over your interests.
The exercise of your right to object may imply the suspension or termination, in whole or in part, of the benefits associated with the purpose of the processing of the data in question.
You can also object to the processing of your data for direct marketing purposes.

8.7 Right to withdraw your consent

In cases where the processing of data is based on your consent, you may withdraw your consent at any time.
If you withdraw your consent, your personal data will no longer be processed, unless there is another ground, such as legal and regulatory obligations or the public interest of PlanetSeason, that justifies such processing.

8.8 Right to lodge complaints with PlanetSeason or the supervisory authority

The exercise of your rights is free of charge, unless the request is manifestly unfounded or excessive, in which case a reasonable fee may be charged considering the associated costs.
The response to your requests must be provided within a maximum period of 30 days, unless it is a particularly complex request, in which case this period may be longer.
