The purpose of these Terms and Conditions of Use is to set out the terms and conditions under which You may use Our online Services, Our website AgeVerif.com or any other feature We offer in connection with the Services We provide.
Any visit, use or registration implies acceptance without any reservation or restriction of these Terms and Conditions of Use.
AgeVerif reserves the right to modify these Terms and Conditions of Use. However, any changes will be effective 30 calendar days after an email is sent to the email address associated with your account and/or a prominent notice is posted on AgeVerif.com. During this period, the User may accept the new Terms and Conditions of Use or stop using the Service without penalty. Continued use of the Service after the expiration of the period constitutes acceptance of the changes.

3. Partners and Third-Party Terms
As part of our Age Verification Service, AgeVerif.com cooperates with various third-party partners to offer a wide range of verification methods. These partners, who are responsible for conducting specific checks, operate under their own policies and terms and conditions of use which We recommend You review.

4. Definitions
The following capitalized words and terms have the meanings defined in the following Terms and Conditions of Use. The following definitions have the same meaning, whether they appear in the singular or plural.
Terms and Conditions of Use: Refers to this document which constitutes the entire agreement between You and PlanetSeason Lda regarding the use of the AgeVerif.com website and its Services.
AgeVerif.com: Also referred to as Us, Our, Our, etc. refers to the company PlanetSeason Lda that owns the AgeVerif.com site, AgeVerif.com being the trademark of the Service offered.
User: Also referred to as You, Your, etc. means any person who visits or uses the AgeVerif.com Services to verify their age and attest to their majority in order to access websites and/or certain types of content prohibited to minors.
Customers: Refers to companies or individuals using the AgeVerif.com Services to restrict access to their websites and/or certain types of content by minors.
Services: Refers to all the services that AgeVerif.com provides to its Users within the framework of these Terms and Conditions of Use.
Age verification methods: Refers to the various methods made available to the User by AgeVerif.com to verify his/her age and attest to his/her majority.
Device: Refers to any device that can access the Service such as a computer, mobile phone or digital tablet.
5. Data protection & GDPR compliance
AgeVerif guarantees that any processing of personal data carried out in the context of the provision of its Services is fully compliant with Regulation (EU) 2016/679 ("GDPR") and Portuguese data protection legislation. In particular, AgeVerif:
• Limits data collection to what is strictly necessary for age verification;
• stores and transmits data only through state-of-the-art technical and organizational measures, including 256-bit end-to-end encryption;
• respects all the rights of the persons concerned (access, rectification, erasure, limitation, portability, opposition);
• imposes an equivalent level of protection on any subcontractors.

6. Description of Services
The purpose of the AgeVerif.com Services is to provide reliable, anonymous and secure online age verification and validation solutions.
The AgeVerif.com Services are intended for any Internet user who wishes to prove that they are of legal age in order to access websites and/or content that are prohibited to minors.
The AgeVerif.com Services are also intended for companies or individuals wishing to restrict access to minors to their websites and/or certain types of content (hereinafter referred to as Customers).
The AgeVerif.com Services are accessible either on the AgeVerif.com site or through an embedded module on the Customers' third-party websites.
The AgeVerif.com Services offer different Age Verification Methods.
Estimate by email
We examine, based on the email address entered by the User, the websites and applications on which this email address has already been used in order to determine their age.
Facial recognition estimation (Selfie)
The User is invited to use the camera of his Device. The captured image is analysed on the User's Device. The entire facial recognition and age determination process is carried out on the User's Device. No images are collected or sent to AgeVerif's servers or the Customers.
Credit card verification
The User is invited to make a single transaction in the amount of one euro (€1.00) coupled with strong two-factor authentication in accordance with the European Directive (EU) 2015/2366 on payment services (known as "PSD2"). Transactions are insured and secured by Stripe, Inc.
Credit card verification coupled with a VPN service subscription
The User is invited to subscribe to one of the subscription offers for a VPN (Virtual Private Network) service. The VPN service is accessible after payment for a period that varies according to the subscription package chosen by the User at the time of subscription. Access to the VPN service begins as soon as the purchase is validated. Transactions are insured and secured by Stripe, Inc.
Verification by AgeVerif ticket (Only in France)
The User must first obtain an AgeVerif ticket from partner tobacconists. The sale of the ticket is subject to the verification of the User's majority by the tobacconist using a valid identity document. The AgeVerif ticket contains a single-use code valid for 2 months. The AgeVerif ticket is not returned, exchanged, reimbursed and cannot be the subject of any consideration in kind, cash or transfer.
Verification with the AnonymAGE application
AnonymAGE is a third-party majority verification solution that allows its users to have their majority verified and validated. The User is invited to scan a QR code or click on a link to launch the AnonymAGE application on their phone or digital tablet. The AnonymAGE application, with which the User will have previously validated his or her majority, confirms or not the User's majority with AgeVerif. The User's data previously transmitted to AnonymAGE to validate his or her majority are not communicated to AgeVerif.com or to the Customers' sites.
Verification with Pleenk
Pleenk is a third-party service for estimating and verifying majority by means of facial recognition (selfie) or by verifying an identity document from which the information necessary to validate the User's age is extracted. The User's data transmitted to Pleenk to validate his or her majority is not communicated to AgeVerif.com or to the Customers' websites.
When the User has verified and validated his/her age with the AgeVerif.com Services, the result is saved in his/her device and he/she can access the websites and/or certain types of content using AgeVerif.com as an age verification method without the need to repeat the age verification process each time.
NO VERIFICATION DATA YOU SUBMIT IS TRANSFERRED TO CUSTOMERS USING THE SERVICES OF AGEVERIF.COM.
Some Age Verification Methods are only valid in certain countries. Depending on the user's geographical location, the Age Verification Methods listed above may not be available.
All exchanges and communications between your Device and AgeVerif.com's servers use 256-bit encryption.
AgeVerif reserves the right to remove, add and/or modify the Age Verification Methods.
7. Duration of validity of proof of age
The validity periods of proof of age are determined by AgeVerif according to the Verification Methods used and the geographical location of the User. These periods are considered reasonable with regard to technical, regulatory and safety requirements. However, AgeVerif reserves the right to modify these durations at any time, in particular in the event of legislative or regulatory changes or recommendations from the competent authorities. The User acknowledges that the expiry of proof of age entails the obligation to carry out a new verification according to the Method of his choice in order to continue to benefit from the Services. In the event of a change in these durations, the User will be informed by email or by a notification on the site.
8. Access
To use Our Services, You must be eighteen (18) years of age or older, or have reached the age of majority in the jurisdiction in which You reside and from which You access AgeVerif.com. You must have the legal capacity to commit to and accept these Terms and Conditions of Use and must not be subject to a legal protection measure for adults (guardianship or curatorship). Otherwise, You may not use the AgeVerif.com Services under any circumstances. AgeVerif.com declines all responsibility in the event of a User's false declaration regarding his or her age.
Although We make reasonable efforts to ensure the availability of AgeVerif.com 24 hours a day, this cannot be guaranteed. Access to AgeVerif.com may be suspended temporarily and without notice in the event of system errors, maintenance or repair work, or for reasons beyond Our control.
9. Subscription
As part of the age verification by credit card coupled with the subscription to a VPN service, the User must first select a subscription offer and make the payment. The subscription becomes effective only after full payment of the price by the User and for a period that varies according to the subscription package chosen.
The duration of the subscription, its price, the automatic renewal terms and conditions as well as the General Terms and Conditions of Sale specific to the selected subscription offer are made available to the User at the time of purchase.
All subscriptions are automatically renewed for the same duration at the end of the subscribed period. They cannot be transferred or assigned.
10. Fees
The AgeVerif.com Services and the majority of Age Verification Methods are free of charge for Users. However, some Age Verification Methods involve payment for which the price and terms of the transaction are specified prior to the use of the Method.
The credit card verification offer is without subscription and is subject to a one-time payment of €1.00 non-renewable payable by credit card.
All subscriptions to a VPN service are paid and payable by credit card.
THE PRICES OF THE PACKAGES AVAILABLE AT THE TIME OF SUBSCRIPTION, EXPRESSED IN EUROS (€) ALL TAXES INCLUDED, THEIR DURATION AND THE TERMS OF AUTOMATIC RENEWAL, ARE DISPLAYED BEFORE ANY TRANSACTION, ON THE PAYMENT PAGE BEFORE THE VALIDATION OF THE ORDER AND IN THE GENERAL TERMS AND CONDITIONS OF SALE THAT YOU MUST ACCEPT BY TICKING THE BOX PROVIDED FOR THIS PURPOSE BEFORE THE ONLINE PAYMENT PROCEDURE.
The current subscription plans are:
• €9.00 for 1 month
• €36.00 for 1 year
• €48.00 for 2 years
All subscriptions are subject to an auto-renewal model based on the price and term stated at the time of the original subscription.
Prices may vary depending on Your geographical location or different promotional offers.
Billing and subscription management are handled by Stripe, Inc.
All payments will appear on your statement as AGEVERIF. PLUS.
IN ORDER FOR YOUR PAID SUBSCRIPTION NOT TO BE AUTOMATICALLY RENEWED, YOU MUST CANCEL IT BY FOLLOWING THE PROCEDURE DESCRIBED BELOW IN THE "SUBSCRIPTION CANCELLATION" SECTION.
We reserve the right to change Our subscription offerings or adjust the prices of Our Services at Our sole discretion. Any price change or modification of Your subscription will be effective after notifying You by email to the address provided when creating Your account and from the beginning of the next billing period following the date of the change.
If We are unable to process the payment or if You file a chargeback request to dispute the charges to Your payment method and the chargeback is accepted, We may suspend or terminate Your User account without notice.
We reserve the right to outsource payment processing to a third-party provider who may impose additional terms. Please review them before any transaction.
To the extent permitted by law, We are not liable for any inconvenience or damage caused by the use of the payment method, including delays or inability to make the payment. In this case, You must complain about these services to their provider in the manner provided in their terms and conditions.
By accepting these Terms and Conditions of Use, You declare that all payments will be made with funds from a legitimate source.
11. Cross-selling
During the age verification processes, you may be offered the option to purchase one or more additional services, with or without a tacitly renewable subscription and with or without a free trial period.
These offers are entirely optional and have no influence on the initial Service if You refuse them.
If You accept the purchase of an additional service, Your purchase will be subject to the Terms and Conditions of Use set forth herein which You must agree to before making the purchase.
In the event that this additional service is provided by a third-party website, We are not responsible for the services it promotes, the content of communications between You and such third-party provider, its Terms and Conditions of Use and sale and its privacy policy. We do not control or warrant the usefulness, merchantability, or workmanship of the services offered on third-party websites.
12. Refunds
Age verification by credit card is carried out through a single transaction with a fixed amount of €1.00. Due to the immediate, irrevocable and fully executed nature of this transaction, this transaction is non-refundable. No refunds will be given once verification has been completed. By proceeding with the transaction, the user expressly acknowledges that the service is delivered instantly and that no right of withdrawal applies in this context.
However, for age verifications associated with a VPN service subscription, refund requests may be considered on a case-by-case basis, in accordance with Our Customer Satisfaction Policy. AgeVerif reserves the right to grant or deny a refund in its sole discretion, subject to the limitations provided by applicable law.
13. User Support
User Support service is provided to Users to assist them in resolving problems related to the use of the AgeVerif.com Website and its Services.
User Support service is accessible by email via our Contact page and responses are given within a maximum of 72 hours, excluding weekends and holidays.
AgeVerif.com has no obligation to provide any other assistance, support, maintenance, or other services or to provide assistance by any other method.
14. User Conduct
When You use the AgeVerif.com Services, You must comply with these Terms and Conditions of Use, the laws, rules and regulations directly applicable to the performance of this agreement, in particular with regard to the protection of minors, the protection of personal data and consumer law, as well as the usage guidelines that AgeVerif.com may communicate to You from time to time.
The User undertakes to provide complete, accurate, truthful personal information that belongs to him/her.
The User undertakes not to use stolen, incorrect or false identification or banking documents.
You may not, including, but not limited to:
• duplicate all or part of AgeVerif.com and its Services;
• create derivative works from AgeVerif.com and its Services;
• exploit or distribute AgeVerif.com and its Services for any business, advertising, promotional, or commercial purposes;
• attempt to remove, disable, circumvent, or circumvent any content protection or access control mechanisms designed to prevent unauthorized downloading, stream scraping, embedding, reproduction, access, or distribution of AgeVerif.com and its Services;
• access AgeVerif.com and its Services by automated means, including robots, data mining, data gathering or extraction tools;
• transmit any material that may harm AgeVerif.com's computer systems, including, but not limited to, any viruses, code, software, data, or other files designed to damage or allow unauthorized access to the Services, and that could cause a defect, error, malfunction, or corruption of the Services;
• use AgeVerif.com and its Services as part of an unsolicited marketing communication campaign (i.e., spam);
• use AgeVerif.com and its Services as part of an unnatural SEO campaign using spam links.
Breach of any of these agreements will result in the termination of Your User account, access to the AgeVerif.com Services and may result in legal action.
15. Subscription cancellation
No subscription comes with a duration commitment. You have the right to cancel Your subscription at any time after You have registered.
You may cancel Your subscription through Stripe, the billing and subscription manager of the AgeVerif.com website, at the following address: https://billing.stripe.com/p/login/aEUbKr8pUefXdrycMM
If You choose to cancel the subscription after the start of normal billing, the subscription will be cancelled immediately but You will continue to enjoy Your User privileges until the end of the paid period. No refunds will be issued for the remaining period of the subscription.
The AgeVerif.com Website may terminate or suspend Your access immediately, without notice, for any reason, including, but not limited to, if You violate these Terms and Conditions of Use, laws relating to infringement, copyright, trademark and privacy laws, as well as for any unlawful conduct. Your User privileges will cease immediately and no refunds will be made for the remaining period of the subscription.
Regardless of the nature of the termination, You will receive an email confirming the termination of Your subscription to AgeVerif.com.
If the AgeVerif.com website disappears or ceases to function, it is obvious that all subscriptions (of any type) will be cancelled immediately without notice.
CANCELLATION OF YOUR SUBSCRIPTION CANNOT GIVE RISE TO ANY REFUND OF PREVIOUS PAYMENTS.
16. Account Termination
The User may delete his or her account at any time AgeVerif.com. If You decide to delete Your AgeVerif account, You will no longer be able to manage the validation of your majority on different devices. Eventually, you will no longer be able to access websites and/or content that are prohibited to minors using the AgeVerif.com Services unless you restart the age verification process.
We may terminate or suspend Your account immediately, for any reason, if You violate these Terms and Conditions of Use, with 30 days' notice sent via Your AgeVerif account or by email. In the event of permanent termination by Us, You will receive an email confirming the termination of Your AgeVerif.com account and Your right to use AgeVerif.com will cease immediately.
Where appropriate, We reserve the right to claim damages in any manner available to Us under applicable law.
If the AgeVerif.com website disappears or ceases to function, it is obvious that all User accounts will be cancelled immediately without notice.
THE TERMINATION OF YOUR USER ACCOUNT CANNOT GIVE RISE TO ANY REFUND OF ANY PREVIOUS PAYMENTS YOU MAY HAVE MADE TO OUR THIRD-PARTY PARTNERS WHEN VERIFYING YOUR MAJORITY.
17. Intellectual property
We are the owner or licensee of the content of the AgeVerif.com website, including but not limited to text, images, photos, videos, logos, trademarks and any other elements protected by national and international intellectual property rights.
All other elements, including but not limited to texts, images, photos, videos, logos, trademarks, displayed or mentioned on AgeVerif.com and belonging to third parties are the property of their respective owners and are protected by national and international intellectual property rights.
Any reproduction, publication, distribution, transmission, dissemination, copying, sale, exploitation, in whole or in part, of the various contents is totally prohibited without the prior written consent of the respective owners. Accordingly, You agree not to disable, circumvent, or interfere with any security features of AgeVerif.com or features that prevent or restrict the use or copying of the AgeVerif.com Website.
18. Licence
Subject to compliance with these Terms and Conditions of Use, We grant You a limited, personal, non-exclusive, non-transferable, non-sublicensable, terminable license to access AgeVerif.com and its Services. This license terminates when You stop using the AgeVerif.com Site and its Services or if You fail to comply with these Terms and Conditions of Use.
Except as previously agreed to in writing by Us, You may not modify (including, but not limited to), create derivative works from, copy, adapt, reverse engineer, distribute, reproduce, republish, download, post, transmit, transfer, license, sublicense, sell in any form or by any means, the Content and Services AgeVerif.com, in whole or in part.
19. Limitation of Liability
You agree to use the AgeVerif.com Website and its Services at Your own risk.
We cannot guarantee that the AgeVerif.com website and its Services will be free from defects, errors or omissions. Despite regular updates, the AgeVerif.com website cannot be held responsible for changes in administrative and legal provisions that occur after publication. Similarly, the site cannot be held responsible for the use and interpretation of the information contained in this site.
We are not responsible for any incidents that may occur during the use of AgeVerif's Services (network or connection problems, incompatibility of your device, etc.).
We are in no way involved in or responsible for monitoring the exchanges and transactions between You and third-party providers of Methods, products or services, We have no control over third-party websites and cannot be held responsible for access to such websites, whether direct or indirect.
AgeVerif.com is provided for domestic and private use only. You agree not to use AgeVerif.com for any commercial purposes and understand that AgeVerif.com has no liability to You for any loss of profit, business interruption, or loss of business opportunity.
AgeVerif.com does not guarantee, endorse or assume responsibility for any website and its content belonging to Customers who use AgeVerif's Services.
20. General provisions
These Terms and Conditions of Use constitute the entire agreement between You and Us in respect of Your access to and use of the AgeVerif.com Website and its Services and supersede all prior agreements.
You may not assign, transfer, sell or delegate Your rights or obligations to any third party without Our written consent.
We may freely assign this Agreement or transfer its rights to a third party, including but not limited to an affiliate, a purchaser, all or substantially all of Our assets, a successor, or in the event of a corporate reorganization, consolidation, or merger.
If one or more terms, clauses or provisions of these Terms and Conditions of Use are declared invalid or unenforceable by a court of competent jurisdiction or an administrative authority of competent jurisdiction, such invalidity shall not affect the validity or enforceability of any other term, clause or provision of these Terms and Conditions of Use and the invalid term, clause or provision shall be deemed severed from this Agreement.

22. Jurisdiction
These Terms and Conditions of Use shall be governed by and construed in accordance with Portuguese law. In the event of a failure to resolve a dispute between You and Us, the Portuguese courts will have sole jurisdiction in the matter.
